If you do not consent to the processing or use of your data by MerchUp in accordance with these data protection provisions in whole or for specific activities, you may submit your objection by e-mail or letter, also using the listed contact details.
  1. Collection, processing, and use of personal data
    Personal data is data concerning factual or personal relations of a specified or identifiable natural person. This includes, for example, your name, telephone number, address, and all basic data provided during registration and creation of a customer account.

    2.1 Collection, processing, and use of your personal data
    We collect, store, and process your data as part of handling purchases, including any subsequent warranties, for the provision of our services, for technical administration, for our own marketing purposes (more on this in point 2.2), and to prevent illegal acts and fraud. Your personal data is transferred to third parties only when it is legally permissible, including for purposes related to contract implementation or billing, for marketing purposes, or with your prior consent. For example, as part of order processing, the service providers we work with (e.g., carrier, logistics company, banks) receive the necessary data to fulfill the order and commission. The data transferred in this way may only be used by the service providers to perform their task.

Additionally, we also use order history.     To send the newsletter, we use the e-mail address you provided. This requires your confirmation, as the owner of the e-mail address, consenting to receive the newsletter. If you would like to unsubscribe from the newsletter, you can cancel your consent at any time without incurring costs other than the costs of transmitting the information according to the basic tariff.     If you have made a purchase at MerchUp, you may receive product recommendation e-mails from us. These messages are sent regardless of whether you have subscribed to the newsletter or not. We want to provide you with information about products from our offer that might interest you based on your recent purchases. If you would like to opt-out of receiving product recommendations or advertising information in general, you can cancel your consent at any time without incurring costs other than the costs of transmitting the information according to the basic tariff. For this purpose, a notification in text form to the contact details listed in point 1 (e.g., e-mail, letter) is sufficient. Of course, an unsubscribe link is available in every e-mail.

    2.2.3 Banner advertising
    We also use data collected during your visit to display so-called banner advertising. These are advertisements that redirect to third-party sites. This advertising mostly uses cookies or pixels. Our goal is to develop an advertising offer that is attractive and useful to you, so as part of banner advertising, you may see primarily products that you have already viewed on our site or products similar to those you viewed earlier (so-called retargeting). Within banner advertising, we only use pseudonymized data; direct information about you (e.g., name or e-mail address) is not stored in cookies.     What are cookies?

    What cookies does MerchUp use?
    Most of the cookies we use are automatically deleted from your computer’s hard drive at the end of the browser session (so-called session cookies). For example, session cookies are used to offer you the shopping cart function across multiple pages. In addition, we also use cookies stored on your hard drive. During your next visit, the service automatically recognizes you and your preferred information and settings. Temporary and permanent cookies (storage period from 1 month to 10 years) are saved on your hard drive and are automatically deleted after a specified time. These cookies are used to make our offer even more effective, safer, and more user-friendly. Thanks to these files, it is possible to present you with information tailored to your interests. The sole purpose of cookies is to best adapt our offer to customer expectations and thus make it easier for you to navigate our service.

    What data is saved in cookies?
    Only pseudonymized data is saved in the cookies used by MerchUp. When the cookie is activated, it is assigned an identification number without assigning your personal data to this identification number. Your name, IP address, or similar data that would allow the cookie to be directly assigned to you are not saved in the cookie. Based on cookie technology, we only receive pseudonymized information, for example, about which pages of our store you visited, which products you viewed, etc.

    Retargeting
    Our websites use so-called retargeting technology. We use this technology to be able to offer you a more attractive internet offer. It allows users who have shown interest in our store and our products to be presented with relevant advertising on our partners’ websites. We are convinced that displaying personalized, interest-based advertising is generally more attractive to the user than advertising that has no such individual connection. The display of these advertising materials on our partners’ sites is based on cookie technology and an analysis of previous user behavior. This form of advertising is carried out completely anonymously. When using our website, cookies are used to collect, save, and use data about user behavior. Furthermore, your data contained in cookies is stored after the end of the browser session and, for example, used during your next visit to the website. How can you block cookies from being saved?     To constantly optimize and improve our offer, we use so-called tracking technologies. We use Google Analytics services for this purpose.

    4.1 Google Analytics
    This website uses the web analytics tool Google (Universal) Analytics from Google Inc. (www.google.com). Google (Universal) Analytics uses methods that allow analysis of your use of the website, for example, cookies, which are text files saved on your computer. The information generated in this way regarding your visit to this website is usually transmitted to a Google server in the USA and stored there. If IP anonymization is activated on this site, your IP address is shortened by Google before being transmitted within member states of the European Union or other signatory states to the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there. The anonymized IP address sent by your browser as part of Google Analytics is not combined with other Google data.     Your personal data is transmitted securely by us using encryption. This also applies to the order process and customer login. We use the TLS (Transport Layer Security) or SSL (Secure Socket Layer) coding system. Furthermore, our websites and other systems are secured by current technical and organizational measures against loss, destruction, access, modification, or distribution of your data by unauthorized persons.

Complaints

  1. The Customer may submit complaints regarding the concluded sales contract via e-mail: hello@rascalindustry.eu
  2. A correctly filed complaint should contain at least:
    1. the Customer’s first name, last name, address, phone number, and e-mail address,
    2. the date of conclusion of the contract forming the basis of the complaint,
    3. a description of the subject of the complaint, indicating the Customer’s request, a description of all circumstances justifying the complaint,
    4. if the data or information provided in the complaint needs to be supplemented, the Seller, before processing the complaint, asks the Customer to supplement it in the indicated scope. 5. the Seller recognizes the complaint within 14 days from the moment of receiving it in the correct form. The response to the complaint is sent to the e-mail address provided by the Customer, to the traditional mail address, or given by phone.


    Withdrawal from the contract
  1. A Customer who is a consumer has the right to withdraw from the contract without giving any reason within 14 days from the moment of receiving the Product. To meet the deadline, it is sufficient to send the statement before its expiry.
    2. To exercise the right to withdraw from the contract, the Customer is obliged to inform the Seller of their decision by means of an unequivocal statement.
    3. The Seller is obliged to immediately, but no later than within 14 days from the date of receiving the Customer’s statement on withdrawal from the contract, return to the Customer all payments made by them, including the costs of delivering the Product.
    4. The Seller may withhold the reimbursement of payments received from the Customer until they have received the Product back or the consumer has supplied evidence of having sent back the Product, whichever is the earliest.
    5. The Customer is obliged to return the Product to the Seller or a person authorized by the Seller immediately, but no later than within 14 days from the day on which they withdrew from the contract. To meet the deadline, it is sufficient to send back the Product before its expiry. 6. The Customer bears the direct costs of returning the Product. If the Customer has chosen a method of delivery of the Product other than the cheapest standard delivery method offered by the Seller, the Seller is not obliged to reimburse the additional costs incurred by the consumer.
    7. The Customer is liable for any diminished value of the Product resulting from using it in a way that goes beyond what is necessary to establish its nature, characteristics, and functioning.

    Refund of payments
    The refund of payments is made using the same payment methods that were used by the Customer in the original transaction, unless the Customer has expressly agreed to another solution. In any case, the Customer will not incur any fees in connection with this refund. In the case of payment by credit card, the refund will be made directly to the Customer’s card.
